Decisions, Decisions: Deciding Between Medicaid and VA Pension

Elder law attorneys must simultaneously navigate between Veterans Affairs (VA) pension benefit rules and Medicaid rules at four key times:

• Initially deciding whether to apply for VA, Medicaid, or both
• A VA case matures into a Medicaid case, whether within Medicaid’s lookback period or not
• Medicaid eligibility is obtained, impacting VA eligibility
• Determining how Medicaid’s rules treat a VA pension benefit, including during initial eligibility determination, patient responsibility calculation, and estate recovery

This presentation will highlight the process for successfully navigating each of these periods.
